In order to process a
School Capacity Determination for purposes of Capacity Review and/or
Concurrency, OCPS must conduct an analysis under the rules set forth in the
Orange County Charter, the 2008 Amended Interlocal Agreement for Public School
Facility Planning and Implementation of Concurrency, and the 2011 First Amended
and Restated Interlocal Agreement for Public School Facility Planning and
Implementation of Concurrency.
The School Capacity
Determination must find that schools and/or Concurrency Service Areas impacted
by a proposed development have sufficient capacity to accommodate the students
projected to be generated by the proposed development. If capacity is not
available, the property owner may require joint jurisdictional approval of
Future Land Use and/or Zoning applications or enter into a Concurrency
Mitigation Agreement (CMA) to address the deficiency.

and the resulting determinations are valid for six (6) months***
Concurrency review for projects located within unincorporated Orange County is handled by Orange County, not OCPS. Please
apply for School Concurrency through Orange County's Concurrency Management
Office (LINK).

APPLICATION SUBMITTAL REQUIREMENTS
Applications will not be processed until all submittal
requirements are received by Facilities Planning.
Informal Capacity
Review
- A tax record depicting the
project site location showing the parcels and parcel ID numbers.
Formal Capacity Review (including municipal Concurrency review)
- This Application must include a
local government case number.
- For an application to be
considered sufficient, the local government planner assigned to the
project by the jurisdiction where the project is located must submit a
signed Proposed Development Profile form, which will include the number of
units vested from Capacity Review and the total number of units to be
reviewed for the capacity determination.
- A tax record depicting the
project site location showing the parcels and parcel ID numbers.
- Copy of Preliminary Plat/Site
Plan, Master Plan or Land Use Plan (as applicable)
- If the Applicant is not the
property owner, an Agent Authorization Form must be completed by the
property owner using the OCPS form (signature dated within 6 months of application submittal).
New Concurrency
Mitigation Agreement (CMA) or Extension/Amendments to CMA or Capacity
Enhancement Agreement (CEA) (including executive order extensions)
Should a formal
capacity review result in a "NOT AVAILABLE" determination, the following will
be required to proceed with entering into a new CMA or a CEA/CMA extension:
- A certified legal survey
(including sketch and description).
- Title Commitment or Ownership & Encumbrance Report, issued
within 90 days of this Application, for the property or properties under
consideration.
- GIS (Geographic Information
System) shapefile matching the legal description based on a certified
survey (on a CD or e-mail) created as a polygon in the following
projection plane: NAD 1983 State Plane Florida East FIPS 0901 Feet. The 5
files required to display in ArcMap are: .shp, .shx, .sbn, .prj, .sbx
(Please contact us if you require additional information regarding the
OCPS Projection Information Standard.)
- If applicable, a phasing
schedule and the estimated start/end dates for each phase.
FEES
Capacity Review
The fee for an informal application is $120.00 and the fee for a
formal application is $600.00.
Payment may be via credit card using SchoolPay (link will be
provided during application process or found at the top of this page) or a
check made payable to Orange County Public Schools. Checks should include the
Project ID# that is generated during the application process.
CEA/CMA
If a new CMA or CEA/CMA amendment is required, an additional mitigation application fee

Recording fees for new CMAs or CEA/CMA amendments are based on the number
of pages of the agreement and are paid by the Applicant. Coordination of the
recording fee payment will occur as applicable.
